Terms of Service

These Terms of Service ("Terms") govern your use of the PostBrain service operated by Martin Hughes, trading as PostBrain ("we", "us", or "our"). By creating an account or using our service, you agree to be bound by these Terms.

1. Description of Service

PostBrain is a social media management platform that uses artificial intelligence to help you create, manage, and publish content across social media platforms. The service includes brand voice analysis, AI-powered content generation, campaign management, content scheduling, and publishing to connected social media accounts.

2. Account Registration

You must create an account to use PostBrain. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when registering. You must be at least 16 years old to use this service.

3. Subscriptions and Billing

PostBrain is a paid subscription service. Plans are billed in advance on a recurring basis (monthly or annually, depending on the plan you select). Payments are processed through Stripe.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods unless required by applicable law.

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a 14-day cooling-off period from the date of purchase. If you wish to cancel within this period, contact us at legal@postbrain.app for a full refund. By using the service before the cooling-off period expires, you acknowledge that you may lose this right if the service has been fully performed.

We reserve the right to change pricing with 30 days' notice. Price changes will not affect your current billing period.

4. Content Ownership

You retain full ownership of all content you create, approve, and publish through PostBrain. This includes your brand materials, approved posts, images, and any other content you provide or generate using our service.

You grant us a limited license to use your content solely for the purpose of providing the service — for example, to store your brand information, generate content suggestions, and publish approved posts to your connected accounts.

5. AI-Generated Content

PostBrain uses AI to generate content suggestions. You acknowledge that:

• AI-generated content is provided as suggestions and requires your review and approval before publication
• You are responsible for reviewing all content for accuracy, appropriateness, and compliance with applicable laws before publishing
• AI-generated content may be inaccurate, incomplete, or misleading. We do not guarantee that it will be free from errors, biases, or hallucinated information
• You are solely responsible for any content you choose to publish, whether AI-generated or not

6. Social Media Connections

When you connect third-party social media accounts, you authorize PostBrain to access and publish content on those platforms on your behalf. You are solely responsible for all content published through your connected accounts, including ensuring it is accurate, lawful, and compliant with each platform's terms of service. We are not liable for any consequences arising from content you approve and publish, including but not limited to reputational harm, account suspensions, content removal, or third-party claims.

7. Acceptable Use

You agree not to use PostBrain to:

• Violate any applicable laws, regulations, or third-party rights
• Generate or publish content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Spam, harass, or engage in misleading or deceptive practices
• Attempt to circumvent usage limits, security measures, or access controls
• Interfere with or disrupt the service or its infrastructure
• Reverse engineer, decompile, or attempt to extract the source code of the service

We reserve the right to suspend or terminate accounts that violate these terms.

8. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted availability. The service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime in advance.

9. Limitation of Liability

To the maximum extent permitted by law, PostBrain shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or reputational harm, arising from your use of or inability to use the service, or from any content generated, approved, or published through the service.

Our total liability for any claims arising from these Terms or your use of the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will meet your specific requirements. AI-generated content may contain mistakes, factual errors, outdated information, or hallucinations, and we make no warranty that such content will be accurate, complete, or suitable for any particular purpose. You should always review AI-generated content before use.

Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015 or any other applicable UK legislation. Where the service does not conform to your statutory rights, you may be entitled to a remedy under those laws.

11. Termination

You may terminate your account at any time by contacting us or using the account deletion feature. We may terminate or suspend your account if you violate these Terms or for any other reason with reasonable notice. Upon termination, your right to use the service ceases immediately. We will delete your data in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the service after changes constitutes acceptance of the new Terms. If you do not agree with the updated Terms, you should stop using the service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
